    Terms of service

    These terms govern your purchase and use of materials supplied by Appalachia Labs. By placing an order you accept them.

    1. Research use only

    All products sold on this site are supplied solely as reference materials for in-vitro laboratory research. They are not drugs, foods, cosmetics, dietary supplements, or medical devices, and they are not for human or veterinary use.

    By placing an order you represent and warrant that:

    • the material will be used exclusively for in-vitro laboratory research, and will not be administered to a human or an animal by any route;
    • it will not be resold, repackaged, relabelled, or otherwise supplied for any consumption, therapeutic, diagnostic, cosmetic, or food use;
    • you are ordering for a research setting, and you are qualified — or supervised by someone qualified — to handle research chemicals safely;
    • you are responsible for determining whether the material is lawful to import, possess, and use in your jurisdiction, and for any licence or institutional approval that requires.

    You must acknowledge this restriction at checkout before an order can be submitted. That acknowledgement is recorded with your order.

    2. Eligibility

    You must be at least 18 years old — or the age of majority where you live, if higher — and able to form a binding contract. Orders placed on behalf of an organisation must be placed by someone authorised to bind it. We may decline or cancel any order at our discretion, including where we believe these terms are not being observed.

    3. Orders, pricing, and acceptance

    Submitting an order is an offer to buy; it is not accepted until we confirm dispatch. Until then we may decline it and refund any amount taken in full — for example if the material is unavailable, if a price or product description was published in error, or if we cannot verify the order.

    Prices are shown in US dollars and exclude any duties or import charges, which are the purchaser’s responsibility. Prices may change at any time; the price that applies is the one displayed when your order is placed.

    4. Shipping and title

    Delivery estimates are estimates, not guarantees. Risk of loss passes on delivery to the carrier; title passes on receipt of payment in full. Geographic restrictions, carriers, handling, and the process for damaged or missing shipments are set out on the shipping page, which forms part of these terms.

    5. Returns

    Because these are temperature-sensitive reference materials whose chain of custody and storage conditions cannot be verified once they leave our control, shipped material is not returnable for change of mind.

    This does not limit your remedies where material arrives damaged, incomplete, or outside the specification on its certificate of analysis. Report those as described on the shipping page and we will replace or refund the affected items.

    6. Certificates of analysis

    Each lot ships with a certificate of analysis describing that lot. The certificate reports the results of the assays named on it, as performed at the time of release, and nothing beyond them. It is not a statement about safety, efficacy, or fitness for any use in a living subject, and it does not warrant the material’s condition after it has been stored or handled outside our control.

    7. Warranty

    We warrant that, at the time of dispatch, material conforms to the specification stated on its certificate of analysis. This is the only warranty we give. To the fullest extent permitted by law, all other warranties — express or implied, including merchantability, fitness for a particular purpose, and non-infringement — are excluded.

    8. Limitation of liability

    To the fullest extent permitted by law, Appalachia Labs is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or the cost of substitute goods, arising from the sale or use of any product — whether the claim is in contract, tort, or otherwise, and even if we were advised such damages were possible.

    Our total aggregate liability arising out of or relating to any product is limited to the amount you paid for that product.

    Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

    9. Indemnity

    You agree to indemnify and hold Appalachia Labs harmless against any claim, loss, or expense arising from your use, handling, storage, or disposal of material purchased here, or from your breach of these terms — in particular any use of the material outside in-vitro laboratory research.

    10. Intellectual property

    The content of this site, including its text, images, and certificates, belongs to Appalachia Labs or its licensors. Nothing in a sale transfers any patent, trademark, or other intellectual property right, and no licence is granted to use any third party’s intellectual property in your work.

    11. Privacy

    Personal information is handled as described in our privacy policy, which forms part of these terms.

    12. Changes

    We may revise these terms. The version in force for an order is the one published when the order is placed, and the date at the top of this page shows when it last changed.
